The terms "personal data", "data subject", "processor" and "sensitive data" have the meaning defined by the General Data Protection Regulation (GDPR: no. 2016-679).

General terms of use of the site and the services offered

The Site constitutes an intellectual work protected by the provisions of the French Intellectual Property Code and applicable international regulations. The Client may not in any way reuse, transfer or exploit for their own account all or part of the elements or works of the Site.

Use of the site https://neotide.fr implies full and unreserved acceptance of the general terms of use described below. These terms of use may be modified or supplemented at any time, so users of https://neotide.fr are invited to consult them regularly.

This website is normally accessible to users at all times. An interruption for technical maintenance may nevertheless be decided by https://neotide.fr, which will then endeavour to inform users beforehand of the dates and times of the work.

The website https://neotide.fr is updated regularly by the person responsible for it. Likewise, the legal notice may be modified at any time: it is nevertheless binding on users, who are invited to refer to it as often as possible in order to take note of it.

However, it cannot be held responsible for omissions, inaccuracies or shortcomings in updating, whether caused by itself or by third-party partners providing that information.

All information given on the site https://neotide.fr is provided for guidance only and is subject to change. Furthermore, the information appearing on the site is not exhaustive. It is given subject to any changes made since it was put online.

Contractual limitations on technical data

The website cannot be held responsible for material damage linked to the use of the site. In addition, users of the site undertake to access the site using recent, virus-free equipment and an up-to-date, latest-generation browser.

The site https://neotide.fr is hosted by a provider within the territory of the European Union, in accordance with the provisions of the General Data Protection Regulation (GDPR: no. 2016-679).

The aim is to deliver a service that ensures the best possible accessibility rate. The host ensures the continuity of its service 24 hours a day, every day of the year. It nevertheless reserves the right to interrupt the hosting service for the shortest possible periods, in particular for maintenance, improvement of its infrastructure, failure of its infrastructure, or if the Services generate traffic deemed abnormal.

https://neotide.fr and the host cannot be held responsible in the event of a malfunction of the internet network, telephone lines, or computer and telephone equipment, linked in particular to network congestion preventing access to the server.

Intellectual property and infringement

https://neotide.fr owns the intellectual property rights and holds the usage rights to all elements accessible on the website, in particular the texts, images, graphics, logos, videos, icons and sounds.

Any reproduction, representation, modification, publication or adaptation of all or part of the elements of the site, whatever the means or process used, is prohibited without the prior written authorisation of https://neotide.fr.

Limitations of liability

https://neotide.fr cannot be held responsible for direct or indirect damage caused to the user's equipment when accessing the website, resulting either from the use of equipment that does not meet the specifications set out under "Contractual limitations on technical data", or from the appearance of a bug or an incompatibility.

https://neotide.fr also cannot be held responsible for indirect damage (such as loss of business or loss of opportunity) arising from use of the site.

Interactive areas (the ability to ask questions in the contact area) are available to users. https://neotide.fr reserves the right to delete, without prior notice, any content posted in this area that would contravene the legislation applicable in France, in particular the provisions relating to data protection. Where applicable, https://neotide.fr also reserves the right to hold the user civilly and/or criminally liable, in particular in the event of a racist, insulting, defamatory or pornographic message, whatever the medium used (text, photograph, etc.).

Management of personal data

How we collect and use your data

The Client is informed of the regulations concerning marketing communication: the French law of 21 June 2014 on confidence in the digital economy, the French Data Protection Act of 6 August 2004, and the General Data Protection Regulation (GDPR: no. 2016-679).

Controllers of personal data collection

For the Personal Data collected when creating the User's personal account and during their browsing of the Site, the controller of the Personal Data processing is: NeoTide, represented by Nicolas JULIE, its legal representative.

As the controller of the data it collects, https://neotide.fr undertakes to comply with the legal provisions in force. It is in particular responsible for establishing the purposes of its data processing, providing its prospects and clients — on the basis of their collected consent — with full information on the processing of their personal data, and maintaining an accurate record of processing activities.

Whenever https://neotide.fr processes Personal Data, it takes all reasonable steps to ensure the accuracy and relevance of that Personal Data with regard to the purposes for which it is processed.

Purpose of the data collected

https://neotide.fr may process all or part of the data:

  • to enable browsing of the Site and the management and traceability of the services ordered by the user: connection and Site usage data, invoicing, order history, etc.
  • to prevent and combat computer fraud (spamming, hacking, etc.): computer equipment used for browsing, IP address, password (hashed)

The neotide.fr and neotide.re sites use Ahrefs Web Analytics, a cookie-free, privacy-respecting analytics tool.

What Ahrefs Analytics collects

  • Aggregated and anonymised browsing data
  • Pages visited, traffic sources, session duration
  • No tracking cookie placed on your device
  • No personally identifiable data passed to third parties

Why no consent banner is required

Ahrefs Analytics is designed privacy-first: it relies on no cookies and collects no data that could personally identify a user. It therefore does not require a consent banner under the ePrivacy Directive.

Retention period

Data is kept only for as long as its purpose requires:

  • Contact data (form) — 3 years from the last exchange
  • Commercial prospecting data — 3 years from the last contact
  • Invoicing and accounting records — 10 years (legal obligation)
  • Connection data and logs — 12 months (legal obligation, LCEN art. 6)
  • Ahrefs analytics data — Aggregated and anonymised, no individual retention

After these periods, data is deleted or irreversibly anonymised.

Right of access, rectification and objection

In accordance with the GDPR (art. 15 to 22)

In accordance with the European regulations in force, Users of https://neotide.fr have the following rights:

  • Access and rectification — right of access (article 15 GDPR) and rectification (article 16 GDPR), updating and completion of Users' data, right to blocking or erasure of personal data (article 17 GDPR) where it is inaccurate, incomplete, ambiguous or out of date, or where its collection, use, disclosure or retention is prohibited
  • Withdrawal of consent — right to withdraw consent at any time (article 13-2c GDPR)
  • Restriction — right to restriction of the processing of Users' data (article 18 GDPR)
  • Objection — right to object to the processing of Users' data (article 21 GDPR)
  • Portability — right to the portability of the data Users have provided, where that data is subject to automated processing based on their consent or on a contract (article 20 GDPR)
  • Fate of data after death — right to determine what happens to Users' data after their death and to choose to whom https://neotide.fr must (or must not) disclose their data, to a third party designated in advance

As soon as https://neotide.fr becomes aware of a User's death and in the absence of instructions from them, https://neotide.fr undertakes to destroy their data, unless its retention proves necessary for evidential purposes or to meet a legal obligation.

If the User wishes to know how https://neotide.fr uses their Personal Data, to ask for it to be rectified, or to object to its processing, the User may contact https://neotide.fr in writing at the following address:

In that case, the User must indicate the Personal Data they would like https://neotide.fr to correct, update or delete, identifying themselves precisely with a copy of an identity document (identity card or passport).

Requests to delete Personal Data will be subject to the obligations imposed on https://neotide.fr by law, in particular regarding the retention or archiving of documents. Finally, Users may lodge a complaint with the supervisory authorities, in particular the CNIL (cnil.fr).

Non-disclosure of personal data

https://neotide.fr refrains from processing, hosting or transferring the Information collected about its Clients to a country outside the European Union or recognised as "inadequate" by the European Commission without first informing the client. That said, https://neotide.fr remains free to choose its technical and commercial subcontractors, provided that they offer sufficient guarantees with regard to the requirements of the General Data Protection Regulation (GDPR: no. 2016-679).

https://neotide.fr undertakes to take all necessary precautions to preserve the security of the Information and in particular to ensure that it is not disclosed to unauthorised persons. However, if an incident affecting the integrity or confidentiality of a Client's Information comes to the attention of https://neotide.fr, it must inform the Client as soon as possible and communicate the corrective measures taken. Furthermore, https://neotide.fr does not collect any "sensitive data".

The User's Personal Data may be processed by subsidiaries of https://neotide.fr and by subcontractors (service providers), solely in order to fulfil the purposes of this policy.

Within the limits of their respective roles and for the purposes set out above, the main people likely to have access to Users' data are the staff of our customer service.

Incident notification and security

Whatever efforts are made, no method of transmission over the internet and no method of electronic storage is completely secure. We therefore cannot guarantee absolute security.

If we became aware of a security breach, we would notify the users concerned so that they could take appropriate measures. Our incident notification procedures take account of our legal obligations, whether national or European. We undertake to fully inform our clients of all matters relating to the security of their account and to provide them with all the information needed to help them meet their own regulatory reporting obligations.

No personal information of users of the site https://neotide.fr is published without the user's knowledge, exchanged, transferred, assigned or sold on any medium to third parties. Cookies

Internet tags

https://neotide.fr may occasionally use internet tags (also known as "tags", action tags, one-pixel GIFs, clear GIFs, invisible GIFs and one-to-one GIFs) and deploy them through a web analytics partner that may be located (and therefore store the corresponding information, including the User's IP address) in a foreign country.

These tags are placed both in online advertisements allowing internet users to reach the Site, and on its various pages.

This technology allows https://neotide.fr to assess visitors' responses to the Site and the effectiveness of its actions (for example, the number of times a page is opened and the information viewed), as well as the User's use of the Site.

Applicable law and jurisdiction

Any dispute relating to the use of the site https://neotide.fr is subject to French law.
